These Terms of Service ("Terms") govern your use of the Colorimetric Pro mobile application ("the App"), operated by INTISEN TECHNOLOGY PRIVATE LIMITED ("we", "us", "our"). Please read them carefully.
1. Acceptance of terms
By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.
2. The service
Colorimetric Pro lets you measure and record color values (RGB, HEX, HSV, CIELAB, and estimated wavelength) using your device's camera or photos, save and organize colors and palettes, and export data as CSV or PDF. Measurements are provided for practical, creative, and educational reference — see Section 8 (Disclaimers) regarding accuracy.
3. Accounts & eligibility
- You must provide a valid mobile number to create an account and verify it via OTP.
- You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
- You must be at least 13 years old to use the App. If applicable local law sets a higher minimum age, that age applies.
- You agree to provide accurate information and to keep it up to date.
4. Subscriptions & billing
The App offers a free Basic plan and paid subscription plans (currently Premium and Gold) with additional save/export limits, billed monthly via our payment partner, Razorpay.
- Prices are shown in the App at the time of purchase and may change with notice.
- Subscriptions renew automatically each billing period unless cancelled before the renewal date.
- You can cancel anytime from your profile; you'll retain access to paid features until the end of the current billing period.
- Refunds are handled according to our separate Refund & Cancellation Policy.
5. Acceptable use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to reverse-engineer, decompile, or tamper with the App or its underlying systems.
- Circumvent or attempt to circumvent subscription limits, payment processes, or access controls.
- Use automated means to access the App in a manner that sends more requests than a human could reasonably produce.
- Upload or process content through the App that infringes the rights of others.
6. Your content
You retain ownership of the photos, saved colors, palettes, and recordings you create within the App ("Your Content"). By using the App, you grant us a limited license to store and process Your Content solely to provide the App's features to you (such as syncing saved data and generating exports). We do not claim ownership of Your Content and do not use it for advertising or to train third-party models.
7. Intellectual property
The App, including its design, code, branding, and underlying technology, is owned by INTISEN TECHNOLOGY PRIVATE LIMITED and protected by applicable intellectual property laws. Except for the limited license to use the App as intended, these Terms do not grant you any rights to our trademarks, logos, or other intellectual property.
8. Disclaimers
The App is provided "as is" and "as available." Color measurements are estimates derived from your device's camera sensor and ambient lighting conditions; while we compute standard color spaces (RGB, HSV, CIELAB) and support reference-mode calibration to improve consistency, we do not guarantee that readings will match a dedicated spectrophotometer or colorimeter. The App should not be relied upon as the sole basis for safety-critical, medical, or regulatory color-matching decisions.
9. Limitation of liability
To the maximum extent permitted by law, INTISEN TECHNOLOGY PRIVATE LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of, or inability to use, the App. Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete your account at any time by contacting us. Sections of these Terms that by their nature should survive termination (such as Intellectual Property and Limitation of Liability) will continue to apply.
11. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Indore, Madhya Pradesh.
12. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
